Footsage LLC is incorporated in Nevada, USA. Footsage®️is an international marketing and scheduling service for independent contractor massage therapists.
All independent contractor massage therapists own and operate their massage business and may choose whether or not to take an appointment.
All independent contractor massage therapists have unique skills and perform them accordingly.
I. Hold Harmless Agreement
In consideration for access to Footsage LLC services, I hereby agree to DEFEND, RELEASE, WAIVE, DISCHARGE, INDEMNIFY, COVENANT NOT TO SUE AND HOLD HARMLESS: Footsage LLC and it’s owners for the risks, injuries and claims for damages because of bodily injury or emotional distress suffered in relation to the massage services performed by the independent contractor massage therapists.
II. Membership
By receiving a Free Birthday Massage with Footsage membership I agree to enter into a subscription term of a minimum of three months from the date of my first massage. I must be a current fully paid member to receive the Free Birthday Massage. The Free Birthday Massage must be redeemed within 7 days of the birthday recorded on file. I enter into this contract for the valuable consideration of a $159.99 Free Birthday Massage. The monthly subscription is $159.99 per month for a 90 minutes body/foot massage or $209.99 for a 120 minutes body/foot massage. There are No Refunds, Massage credits never expire during the term of the membership. Massage credits are good for 365 days after last payment. The Subscription will continue on a month to month basis after the initial three-month term. The membership must be terminated by written 30 Day notice to Footsage at [email protected].
III. Covid 19
*ASSUMPTION OF THE RISK AND WAIVER OF LIABILITY RELATING TO CORONAVIRUS/COVID-19 THE NOVEL CORONAVIRUS, COVID-19, HAS BEEN DECLARED A WORLDWIDE PANDEMIC BY THE WORLD HEALTH ORGANIZATION. COVID-19 IS EXTREMELY CONTAGIOUS AND IS BELIEVED TO SPREAD MAINLY FROM PERSON-TO-PERSON CONTACT. AS A RESULT, FEDERAL, STATE, AND LOCAL GOVERNMENTS AND FEDERAL AND STATE HEALTH AGENCIES RECOMMEND SOCIAL DISTANCING AND HAVE, IN MANY LOCATIONS, PROHIBITED THE CONGREGATION OF GROUPS OF PEOPLE. FOOTSAGE LLC HAS PUT IN PLACE PREVENTATIVE MEASURES TO REDUCE THE SPREAD OF COVID-19; HOWEVER, FOOTSAGE CANNOT GUARANTEE THAT YOU WILL NOT BECOME INFECTED WITH COVID-19. FURTHER, CONTACT WITH A FOOTSAGE MASSAGE THERAPISTS COULD INCREASE YOUR RISK OF CONTRACTING COVID-19. BY ORDERING A MASSAGE FROM FOOTSAGE, I ACKNOWLEDGE THE CONTAGIOUS NATURE OF COVID-19 AND VOLUNTARILY ASSUME THE RISK THAT I MAY BE EXPOSED TO OR INFECTED BY COVID-19 BY THE CONTRACTED FOOTSAGE MASSAGE THERAPIST AND THAT SUCH EXPOSURE OR INFECTION MAY RESULT IN PERSONAL INJURY, ILLNESS, PERMANENT DISABILITY, AND DEATH. I UNDERSTAND THAT THE RISK OF BECOMING EXPOSED TO OR INFECTED BY COVID-19 DURING MASSAGE SERVICES MAY RESULT FROM THE ACTIONS, OMISSIONS, OR NEGLIGENCE OF MYSELF AND OTHERS, INCLUDING, BUT NOT LIMITED TO FOOTSAGE CONTRACTED MASSAGE THERAPISTS. I VOLUNTARILY AGREE TO ASSUME ALL OF THE FOREGOING RISKS AND ACCEPT SOLE RESPONSIBILITY FOR ANY INJURY TO MYSELF AND MEMBERS OF MY HOUSEHOLD (INCLUDING, BUT NOT LIMITED TO, PERSONAL INJURY, DISABILITY, AND DEATH), ILLNESS, DAMAGE, LOSS, CLAIM, LIABILITY, OR EXPENSE, OF ANY KIND, THAT I OR MY HOUSEHOLD MEMBERS MAY EXPERIENCE OR INCUR IN CONNECTION WITH HOUSEHOLD MEMBERS ATTENDANCE AT THE TIME OF THE IN HOME MASSAGE. ON MY BEHALF, AND ON BEHALF OF MY HOUSEHOLD MEMBERS, I HEREBY RELEASE, COVENANT NOT TO SUE, DISCHARGE, AND HOLD HARMLESS FOOTSAGE LLC AND IT’S CONTRACTED MASSAGE THERAPIST, ITS EMPLOYEES, AGENTS, AND REPRESENTATIVES, OF AND FROM THE CLAIMS, INCLUDING ALL LIABILITIES, CLAIMS, ACTIONS, DAMAGES, COSTS OR EXPENSES OF ANY KIND ARISING OUT OF OR RELATING THERETO. I UNDERSTAND AND AGREE THAT THIS RELEASE INCLUDES ANY CLAIMS BASED ON THE ACTIONS, OMISSIONS, OR NEGLIGENCE OF FOOTSAGE LLC, ITS CONTRACTED MASSAGE THERAPIST, ITS EMPLOYEES, AGENTS, AND REPRESENTATIVES, WHETHER A COVID-19 INFECTION OCCURS BEFORE, DURING, OR AFTER PARTICIPATION IN ANY MASSAGE SESSION.
IV. Legal Notice
All notices from Footsage to You may be posted on our Web site and will be deemed delivered within thirty (30) days after posting. Notices from You to Footsage shall be made either by regular mail, sent to the address we provide on our Web site, or first class mail to our address at:
Delivery shall be deemed to have been made by You to Footsage five (5) days after the date sent.
